Worth Knowing
Which Business Tax Return You File, and When It Is Due
The return a business files depends on how it is taxed, not on what it is called. These are the federal and Florida rules from IRS Publication 509 (2026) and the Florida Department of Revenue.
- Federal returns by entity
- A partnership files Form 1065, due on the 15th day of the 3rd month after its tax year ends, and gives each partner a Schedule K-1. An S corporation files Form 1120-S on the same schedule and gives each shareholder a Schedule K-1. A C corporation files Form 1120, due on the 15th day of the 4th month after year end. For a calendar-year business that is March 15 for Forms 1065 and 1120-S and April 15 for Form 1120, moved to the next business day when the date falls on a weekend or legal holiday. A corporation or eligible entity that wants S corporation treatment makes the election on Form 2553.
- Extensions
- Form 7004 requests an automatic 6-month extension of time to file certain business income tax, information and other returns. Publication 509 also notes a 7-month extension for some Form 1120 filers with a June 30 year-end.
- The Florida corporate return, Form F-1120
- Florida’s corporate income/franchise tax applies to corporations and to entities taxed as corporations for federal purposes. They file Form F-1120 every year, even when no tax is due. It is due on the later of two dates: the 1st day of the 5th month after the tax year closes (the 4th month for a June 30 year-end), or the 15th day after the original due date of the related federal return. A single-member LLC that is disregarded for federal and Florida income tax purposes does not file its own Florida corporate return.
- How much do LLCs pay in taxes in Florida?
- It depends on how the LLC is taxed. Florida’s constitution, Article VII, section 5, bars a state tax on the income of natural persons, so Florida has no personal income tax. Federal tax is a separate question.
- Sales tax, payroll tax and next year’s estimates
- A business that makes taxable sales in Florida registers with the Department of Revenue before it starts; the state sales tax rate is 6%, plus a county discretionary surtax. Florida employers file a quarterly reemployment tax report, Form RT-6. Partners and S corporation shareholders generally pay federal estimated tax on Form 1040-ES, due on the 15th day of the 4th, 6th and 9th months and of the 1st month after year end.
- Is a CPA better than a tax preparer?
- The IRS lists the kinds of paid preparers: CPAs, enrolled agents, attorneys, and many others who hold no professional credential. Anyone with a Preparer Tax Identification Number (PTIN) can prepare returns for pay, and the IRS notes that skill levels differ. In Florida, only an actively licensed person may use the title “certified public accountant” (section 473.322(1)(b), Florida Statutes). Drew Green is listed in the IRS Directory of Federal Tax Return Preparers with Credentials as a Certified Public Accountant in Orlando.
